Terms of Use

Much & More Media, Inc.

These Terms of Use ("Terms") are a binding agreement between you and Much & More Media, Inc. ("MMM," "we," "us"), a Texas corporation. They govern your use of the Gina website and the Gina application (together, the "Service"). Please read them carefully. By creating an account or using the Service, you agree to these Terms and to our Privacy Policy and our Consumer Health Data Privacy Policy, which are incorporated by reference.

Section 1 · Acceptance of these terms

You accept these Terms when you create an account or use the Service. If you do not agree, do not use the Service. When we make material changes, we will ask you to accept the updated Terms before you continue. For health data, where the law requires it, we will obtain your separate consent before a material change takes effect.

Section 2 · Eligibility

The Service is offered only to residents of the United States and Canada who are 18 years of age or older. By using the Service you confirm that you meet these requirements. The Service is not offered to residents of the European Union, the United Kingdom, or the European Economic Area during this beta.

Section 3 · The Service

Gina is a general-wellness and self-reflection tool. It brings together signals you choose to provide, including data from a connected wearable, information you enter, and timing inputs, and reflects them back to support your own thinking and decision-making. Gina is for general wellness and informational purposes only.

Section 4 · Your inputs and connected services

You decide what to connect and what to enter. If you connect a wearable device, you authorize us to receive data from that provider on your behalf, and your use of that device remains governed by the provider's own terms and privacy policy. You can disconnect a wearable and delete wearable-sourced data at any time in Settings. You are responsible for the accuracy of the information you provide and for keeping your connected accounts secure.

Section 5 · Gina does not provide medical, legal, or financial advice

Gina is not a medical device and does not provide medical, mental-health, legal, financial, or other professional advice, diagnosis, or treatment. It is a general-wellness tool. Nothing in the Service is a substitute for advice from a qualified professional. Always seek the advice of your physician or another qualified health provider with any questions about a medical condition, and never disregard or delay seeking professional advice because of something Gina presented. If you think you may have a medical emergency, call your doctor or emergency services immediately. Gina does not predict the future or guarantee any outcome.

Section 6 · Decision support; your responsibility for your decisions

Gina is designed to support your own decisions, not to make them for you. Any read, score, prompt, or suggestion is one input for your consideration. You are solely responsible for the decisions you make and the actions you take. You agree that you will not rely on the Service as the sole basis for any decision that affects your health, finances, safety, or legal rights.

Section 7 · Your account

You are responsible for activity under your account and for keeping your credentials confidential. Tell us promptly if you believe your account has been compromised.

Section 8 · Your content and notes

As between you and MMM, you own the information and notes you provide ("Your Content"). You grant us a limited license to host, process, and use Your Content to operate and provide the Service to you, and to maintain and improve the Service using de-identified or aggregated data. We do not use information that identifies you to train third-party artificial-intelligence models. We describe how we handle your information, including your health data, in the Privacy Policy and the Consumer Health Data Privacy Policy.

Section 9 · Feedback

If you send us suggestions or feedback, you grant us a perpetual, royalty-free license to use it without obligation to you.

Section 10 · Acceptable use

You agree not to: use the Service for any unlawful purpose; present Gina's output as professional advice to others; attempt to access accounts or data that are not yours; interfere with or disrupt the Service; reverse engineer or scrape the Service except as permitted by law; or use the Service to build a competing product. We may suspend or end access that violates these Terms.

Section 11 · Intellectual property

The Service, including its software, design, content, and the names and marks associated with Gina and MMM, is owned by MMM or its licensors and is protected by law. These Terms do not grant you any right in our intellectual property except the limited right to use the Service.

Section 12 · Third-party services

The Service relies on third-party providers, including your wearable provider and other vendors. Those providers supply their services "as is," and we do not control and are not responsible for their products, accuracy, or availability. To the fullest extent permitted by law, third-party providers have no warranty obligation to you through us and are not liable to you for any indirect, incidental, special, consequential, exemplary, or punitive damages arising from the Service. Your use of a third-party provider's device or service is also governed by that provider's own terms.

Section 13 · Fees and subscriptions

The beta is provided free of charge. If we introduce paid features in the future, we will present the price and terms before you are charged.

Section 14 · Beta service

The Service is offered as a beta for evaluation. It may contain errors, may change, and may be modified, suspended, or discontinued at any time without notice. Features are not guaranteed, and data or settings may be reset during the beta. We may contact you for feedback. The beta is provided "as is" and "as available," and the disclaimers and limitations in Sections 16 and 17 apply with full force.

Section 15 · Privacy

Your privacy matters. Our Privacy Policy explains what we collect and how we use it. Because Gina involves health-related information, our Consumer Health Data Privacy Policy describes, on its own page, how we handle that data and the consents we obtain. Both are incorporated into these Terms.

Section 16 · Disclaimer of warranties

To the fullest extent permitted by law, the Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any result, score, or reflection is accurate or suitable for your circumstances. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you, and you may have rights that this section does not limit.

Section 17 · Limitation of liability

To the fullest extent permitted by law, MMM and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, or goodwill, arising out of or relating to the Service. To the fullest extent permitted by law, our total liability for all claims relating to the Service will not exceed one hundred US dollars ($100). These limits do not apply to liability that cannot be excluded or limited by law, including, where applicable, liability for gross negligence, willful misconduct, personal injury, or certain consumer-protection and privacy claims; in those cases your rights and remedies under applicable law are preserved.

Section 18 · Indemnification

You agree to indemnify and hold MMM harmless from claims arising out of your misuse of the Service or your violation of these Terms or of applicable law, except to the extent the claim arises from our own conduct.

Section 19 · Term and termination

These Terms apply while you use the Service. You may stop and delete your account at any time. We may suspend or end your access if you violate these Terms or to protect the Service or other users. Sections that by their nature should survive, including Sections 8, 11, 12, 16, 17, 18, and 21, survive termination.

Section 20 · Changes to these terms

We may update these Terms. If a change is material, we will notify you and ask you to accept the updated Terms before you continue to use the Service. The "Effective date" above shows when the current version took effect.

Section 21 · Governing law; dispute resolution

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Denton County, Texas, and each party consents to that jurisdiction and venue and waives any objection based on inconvenient forum.

Time to bring a claim. Any claim arising out of or relating to these Terms or the Service must be filed within one year after it arises, or be permanently barred, except where a longer period is required by non-waivable law.

Canadian consumers. If you are a consumer in Canada, this governing-law and venue provision applies only to the extent permitted by the mandatory law of your province or territory. You may have the right to bring claims locally and to the protections of local consumer law, and nothing here removes those rights.

Section 22 · International users; cross-border data

The Service is operated from the United States, and your information is processed in the United States and where our service providers operate. If you use the Service from Canada, you understand and agree that your information is transferred to and processed in the United States, and you consent to that transfer. The rights available to you by region are described in the Privacy Policy and, for your health data, in the Consumer Health Data Privacy Policy.

Section 23 · Notice for California users

Under California Civil Code section 1789.3, California users are entitled to the following notice: the provider of this Service is Much & More Media, Inc., 5000 Eldorado Parkway, Suite 150-144, Frisco, TX 75033. The beta is provided free of charge. To file a complaint or receive further information, contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.

Section 24 · Miscellaneous

These Terms, with the Privacy Policy and the Consumer Health Data Privacy Policy, are the entire agreement between you and MMM about the Service. If a provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
